CNHJ AND THE SUPREME PEOPLE’S COURT OF CHINA : SIGNING A PARTNERSHIP PROTOCOL


On 25 February in Beijing, President Patrick Sannino signed a protocol linking the National Chamber of French Bailiffs with the Supreme People’s Court of China represented by Mr LIU Guixiang, judge and director general of the enforcement bureau. This agreement, within the context of the fiftieth anniversary of the establishment of diplomatic relations between the People’s Republic of China and France, reinforces existing links and formalizes the principle of regular exchanges between the two institutions. 

This bilateral agreement opens the perspective in China for the future installation of a modernized enforcement system and a profession which could be modelled on the French bailiffs’ system. It plans the setting up of annual experts’ visits within the framework of preparing eventual legislation and regulations, the organization of colloquiums in China, internships and studies by representatives of the People’s Republic in France and information and documentation exchange by the two signatories.

Since 2006, the National Chamber of Bailiffs has taken the initiative to organise specific visits to the People’s Republic of China with the aim of promoting the French judicial enforcement system as well as the status of the bailiff, and to strengthen in the same way the influence of civil law. It is thus a new era which is opening up and which will be marked in years to come by the acceleration of exchange programmes.
