  • Contact a bailiff. Go to his or her office with your mobile phone and any other documentary evidence of the registered ownership of the telephone line so that the bailiff can draft a statement of fact relating to the messages.
  • Voice messages are not necessarily kept indefinitely on your mobile phone, therefore it is prudent to act quickly.
  • The bailiff will certify the time that the message was received and will ensure that an accurate transcript of the message is prepared in order to preserve the evidence.
  • In the case of a voice message the bailiff can make a recording of it which he or she will annex to the certified report of the statement of facts.
